WESLEY E. WRIGHT: Guardianship is a legal relationship between a guardian, an incapacitated person, and the court. Guardianships are sometimes needed to take charge over the decisions of another person in regard to their person and/or their estate. Sometimes a guardianship is unavoidable, maybe you have an elderly parent who has dementia and who's staying in a house where they are not safe due to their inability to care for themselves. Sometimes a family member is no longer able to handle their finances, they may be developing irrational spending habits or they may be taken advantage of by care takers or opportunists.
MOLLY DEAR ABSHIRE: Or you may have a developmentally challenged child who is reaching adult age and will need to be under the supervision of a guardian for the rest of their life. We will help you determine how much of a guardianship is needed so as not to over do it. This will allow the guardian to assert control over things the incapacitated person is unable to handle any longer.
