Too often, the families of people with Alzheimer's disease or dementia find themselves in guardianship proceedings as the only way to transfer control of their loved ones' assets. Once a guardianship is established, then the assets are in the hands of the court — this court control may yield results contrary to the true wishes and desires of the person with dementia or Alzheimer's disease.
By putting into place an estate plan during the early stages of dementia or Alzheimer's disease, you may be able to prevent the wasting of assets. You may also be able to dictate how your assets are used for your care. Wright Abshire, Attorneys, can help. Alzheimer's Disease, Dementia and Medicaid Planning
Eventually, most people with dementia or Alzheimer's disease will need continuous licensed nursing care in a nursing home. With proper planning, Medicaid will pay for most or all of the nursing home expenses, for many people.
However, proper advance planning really is necessary. In cases where a family member is developing dementia or Alzheimer's disease, early planning is especially important. The family member needs to make decisions about financial matters while he or she still has the mental capacity to do so.
If you do nothing, your family member is likely to end up in a guardianship proceeding subject to court control and out of the hands of the family.
