People often think of establishing a legal guardianship when they think of caring for a family member who is disabled, but guardianships are a complex legal procedure and can be costly. Guardianships can also be a major inhibitor to Medicaid planning.

Without advanced planning, a family may find themselves in a guardianship relationship with an elderly family member — a court-defined relationship that may not allow for Medicaid planning or other advanced estate planning.

Consider Other Tools Besides a Legal Guardianship

We urge all families with aging family members to consider establishing powers of attorney for healthcare and durable powers of attorney for property. Advanced planning is critically important. Powers of attorney must be established before a person loses the capacity to execute the required documentation.

When Guardianship Is Unavoidable

There are, of course, times when legal guardianship of a parent or other family member will be necessary — such as when a catastrophic injury or disability renders a person incapable of decision-making and daily life activities.

In addition to helping establish the guardianship, we give advice regarding how the guardianship will impact the family's ability to use any income or assets for the disabled family member's medical care — including Medicaid eligibility for nursing home care.
